Terms, Cancellation & Privacy Policy

Please read these terms carefully before booking with Nova Homes. By booking with us you agree to everything below.

These Terms and Conditions apply to any visitors, users and any other persons who access and/or use the services of Nova Homes on this platform. Upon accessing or using this platform, you accept the duties and liabilities under these Terms and Conditions on your own behalf and on behalf of every consumer, and you represent and warrant that you have read, understood and fully accepted these Terms and Conditions.

Nova Homes is a platform that allows its customers to plan for and/or book affordable accommodation and experiences at the comfort of their devices, anywhere at any given moment. The platform is and will at all times remain the property of Nova Homes, Kenya.

1. Definitions

"Nova Homes Services" means the services that Nova Homes customises and provides to the Customer on the said platform.

"Customer Data" means any data provided by customers to Nova Homes by and through the platform or social media.

"Confidential Information" means any data or information of value to the Customer or to Nova Homes that is not generally known to competitors, including but not limited to customer lists, pricing policies, business methods and financial information.

2. Rights to Access and Use

Nova Homes grants the Customer a nonexclusive, non-transferable right to access and use the platform solely for the Customer's personal use and travel planning.

Restrictions and Prohibited Use

The Customer may not use Nova Homes services to compete with Nova Homes, resell services to third parties, gain unauthorised access to the platform, impersonate any person or entity, or use the platform for any purpose that violates applicable Kenyan law.

3. Cancellation Policy

At Nova Homes, we understand that plans can change and we strive to accommodate these changes to the best of our ability.

These policies apply to all bookings made on any Nova Homes platform including social media, website, WhatsApp, calls and in person.

Standard Bookings — Groups of 1 to 9 people

Refunds take up to 40 business days to process.

Agents, Companies & Groups of 10 or more

Refunds take up to 40 business days to process.

December Bookings — Groups under 10 people

Refunds take up to 40 business days to process.

Yacht Cruising & Activities

Refunds take up to 30 business days to process.

Host Cancellation Policies

If a host's cancellation policy has been accepted and presented prior to booking, it will be enforced. In such instances, any refund will be issued minus the service charges imposed by Nova Homes.

4. Damage of Items

The guest is responsible for any damaged or missing items, as indicated in the check-in list provided by the host upon arrival. The host will conduct a thorough inventory check before check-in and after checkout. In the event of any damage or missing items, the guest and host are encouraged to discuss the value of items before checkout to ensure a fair resolution.

5. Payments

Services shall not be provided unless the requisite amounts are fully received in advance by Nova Homes. All payment obligations are non-cancellable and non-refundable unless in accordance with the cancellation policy above. If you believe a payment request is incorrect, contact Nova Homes within 24 hours from the date of the request.

Invoices shall be forwarded to the customer within 30 days from the date of receipt of payment. The Customer shall pay all applicable transaction taxes and government-imposed charges on amounts payable under these Terms and Conditions.

6. Confidentiality

Each party will take reasonable precautions to prevent unauthorised use or disclosure of the other party's confidential information. Neither party will disclose any confidential information to any third party for a period of no less than 7 years following the termination of the service relationship.

7. Data Protection & Privacy

Data Use

Our website address is: novahomes.co.ke. Where required, personal data may be shared with third parties including vendors and partners. Nova Homes will restrict access to personal data to the extent needed for performance of services.

Comments & Forms

When visitors leave comments or fill in forms on the site, we collect the data shown in the form, and also the visitor's IP address and browser user agent string to help spam detection.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies for your convenience. These cookies will last for one year. Login cookies last for two days and screen options cookies last for a year.

Embedded Content

Articles on this site may include embedded content such as videos and images. Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website directly.

How Long We Retain Your Data

If you leave a comment, the comment and its metadata are retained indefinitely so we can recognise and approve follow-up comments. For users that register on the website, we also store the personal information they provide in their user profile. All users can see, edit or delete their personal information at any time.

Your Rights Over Your Data

You can request to receive an exported file of the personal data we hold about you, or request that we erase any personal data we hold about you. This does not include data we are obliged to keep for administrative, legal or security purposes.

8. Intellectual Property

All intellectual property rights in the Nova Homes platform and services are the sole and exclusive property of Nova Homes or its licensors. The Customer agrees to take no action inconsistent with Nova Homes's intellectual property rights.

9. Limitation of Liability

Nova Homes provides services "as is." Nova Homes does not warrant that any service will operate uninterrupted or error-free, or that specific business results will be achieved. Nova Homes is not responsible for any delays or damages resulting from internet limitations or forces outside of Nova Homes's control.

Under no circumstances will Nova Homes be liable for any indirect, special, incidental, punitive or consequential damages of any kind, including loss of profits, loss of data or system disruption.

10. Governing Law

These Terms and Conditions and any dispute arising out of or relating to them will be governed by the Laws of Kenya. Any dispute will first be addressed through senior management discussion. If unresolved within 30 days, either party may demand arbitration in accordance with the Laws of Kenya, with the seat of arbitration in Kenya.

11. Modifications

Nova Homes reserves the right to modify these Terms and Conditions at any time, effective upon posting of an updated version. Continued use of the platform after any such change constitutes acceptance of the changes.

12. Entire Agreement

These Terms and Conditions represent the entire agreement between the parties and expressly supersede and cancel any other communication, representation or advertising whether oral or written on the subjects herein.
